Terms of Service
Last updated: April 2025. These Terms govern your use of the Montu marketing automation platform operated by Heracleon Group.
1. Acceptance of Terms
By accessing or using Montu ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all clients, visitors, and users of the Service. Montu is operated by Heracleon Group ("we", "us", "our").
2. Description of Service
Montu is an AI marketing automation platform. The Service includes, where enabled by your plan: • Site audit and sitemap analysis • Competitor analysis and keyword strategy • Generation of articles, product descriptions, landing pages, and category copy • Generation of platform-specific social media posts for Facebook, X, LinkedIn, Instagram, and TikTok • Generation of branded design assets — article covers, social graphics, banners, and product visuals • Ad strategy briefs (Ads Pilot — where enabled) • Automated publishing to WordPress, Shopify, WooCommerce, and custom CMSs via webhook • Montu Pilot — orchestrated automation that runs the above on a schedule you set The Service is provided on a monthly subscription basis. We reserve the right to modify, add, suspend, or discontinue features at any time with reasonable notice.
3. Subscriptions and Billing
All subscriptions are billed monthly or annually depending on the plan you select. Payments are processed securely by Paddle, our authorized Merchant of Record. We do not store or process your card or payment information. Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time from your account settings or by emailing contact@montuai.com. Cancellations take effect at the end of the current billing period — no partial-period refunds are issued. Prices are listed in USD and may change with 30 days' written notice to active subscribers.
4. Tokens and Usage
Each plan includes a monthly token allocation that powers content generation, design, and other automated actions. Tokens reset at the start of every billing cycle and do not roll over. If you exhaust your monthly tokens, generation will pause until the next cycle or until additional tokens are purchased. Token consumption rates and remaining balances are shown in your dashboard at all times.
5. Refund Policy
Due to the nature of the Service (digital content and automated production), all sales are final. We do not offer refunds after content production has begun for a billing period. If you believe there has been a billing error, contact us within 7 days of the charge at contact@montuai.com and we will investigate promptly.
6. Client Obligations
You agree to: (a) provide accurate account information including your business name, website URL, and email address; (b) keep your login credentials secure and not share them with third parties; (c) grant us reasonable access to your website, CMS, and connected social channels so we can deliver the Service; (d) ensure you have the right to publish content on the destinations you connect (your own sites, social accounts, and stores); (e) use the Service only for lawful purposes and in compliance with applicable laws, platform policies, and advertising regulations; (f) not resell, sublicense, or redistribute the Montu platform itself or its automation systems.
7. Intellectual Property
Upon full payment for a billing period, all content, designs, and assets produced by Montu for your account during that period are owned by you. We retain no rights to publish or distribute your content. The Montu platform, brand, technology, pipelines, and orchestration systems remain the exclusive property of Heracleon Group. You may not reverse-engineer, copy, or replicate our automation systems or attempt to extract our underlying prompts or workflows.
8. Connected Accounts and Publishing
When you connect a website, CMS, or social account to Montu, you authorize us to publish content on your behalf according to your plan and Pilot configuration. You can pause Pilot, revoke connections, or disconnect any platform at any time from your dashboard. We are not liable for content removal, account restrictions, or platform penalties applied by third-party services (e.g. WordPress, Shopify, Meta, X, LinkedIn, TikTok) as a result of their own policies or algorithm decisions.
9. Quality and Outcomes
We apply automated quality checks to every piece of content, design, or asset before delivery. While we strive for high quality output, we do not guarantee specific outcomes such as search ranking, traffic, sales, or audience growth. Marketing results depend on many factors outside our control including search engine and social platform algorithm changes, competitive landscapes, market conditions, and your site's technical health. We do guarantee that all output will be original, checked against quality standards, and delivered according to your plan specifications.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Heracleon Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost data, arising from your use of the Service. Our total cumulative liability to you shall not exceed the total fees paid by you in the three months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Confidentiality
Both parties agree to keep confidential any non-public information shared in the course of the Service relationship, including but not limited to business strategy, performance data, brand profiles, and content pipelines. This obligation survives termination of the Service.
13. Termination
Either party may terminate the Service relationship at any time. We may terminate or suspend your account immediately if you breach these Terms, engage in fraudulent activity, or use the Service in a manner that harms other clients or the integrity of our systems. Upon termination, your access to the dashboard will be revoked. Content already delivered to you remains yours.
14. Governing Law
These Terms are governed by the laws of the jurisdiction of our principal place of business. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts in our jurisdiction.
15. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated by email to your registered address at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
