Terms of Service
Last updated: April 2025. These Terms govern your use of the Montu platform and services operated by Heracleon Group.
1. Acceptance of Terms
By accessing or using Montu ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all clients, visitors, and users of the Service. Montu is operated by Heracleon Group ("we", "us", "our"), based in 6 October City, Egypt.
2. Description of Service
Montu provides AI-powered SEO content automation services including keyword research, content generation, quality scoring, and content delivery for eCommerce and service businesses. The Service is provided on a monthly subscription basis. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
3. Subscriptions and Billing
All subscriptions are billed monthly. Payments are processed securely by Paddle, our authorized payment processor. We do not store or process your credit card or payment information. Subscriptions automatically renew each month unless cancelled. You may cancel at any time from your account settings or by contacting us at omar@heracleon.com. Cancellations take effect at the end of the current billing period — no partial-month refunds are issued. Prices are listed in USD and are subject to change with 30 days' written notice.
4. Refund Policy
Due to the nature of the Service (digital content production), all sales are final. We do not offer refunds after content production has begun for a billing period. If you believe there has been a billing error, contact us within 7 days of the charge at omar@heracleon.com and we will investigate promptly.
5. Client Obligations
You agree to: (a) provide accurate account information including your business name, website URL, and email address; (b) keep your login credentials secure and not share them with third parties; (c) grant us reasonable access to your website and required integrations to deliver the Service; (d) use the Service only for lawful purposes and in compliance with applicable laws and regulations; (e) not resell, sublicense, or redistribute content produced under the Service without prior written consent.
6. Intellectual Property
Upon full payment for a billing period, all content produced by Montu for your account during that period is owned by you. We retain no rights to publish or distribute your content. The Montu platform, brand, technology, and processes remain the exclusive property of Heracleon Group. You may not reverse-engineer, copy, or replicate our automation systems.
7. Content Quality and Guarantees
We apply quality scoring to every piece of content before delivery. While we strive for high quality, we do not guarantee specific search ranking outcomes or traffic results. SEO results depend on many factors outside our control including search engine algorithm changes, competitive landscapes, and your website's technical health. We do guarantee that all content will be original, scored, and delivered according to your plan specifications.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Heracleon Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost data, arising from your use of the Service. Our total cumulative liability to you shall not exceed the total fees paid by you in the three months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Confidentiality
Both parties agree to keep confidential any non-public information shared in the course of the Service relationship, including but not limited to business strategy, site performance data, and content pipelines. This obligation survives termination of the Service.
11. Termination
Either party may terminate the Service relationship at any time. We may terminate or suspend your account immediately if you breach these Terms, engage in fraudulent activity, or use the Service in a manner that harms other clients or the integrity of our systems. Upon termination, your access to the dashboard will be revoked. Content already delivered to you remains yours.
12. Governing Law
These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes arising under these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts in 6 October City, Egypt.
13. Changes to Terms
We reserve the right to update these Terms at any time. Material changes will be communicated by email to your registered address at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
